[15.05.2OO2] Constitutional Court admits an appeal over the border agreement ratification

Chairman of the parliamentary committee on legality and court reforms Azimbek Beknazarov told RFE/RL correspondent on 15 May that the Constitutional Court admitted an appeal by his committee over the border agreement with China and its ratification by the lower parliamentary chamber. According to the agreement, Kyrgyzstan transfers about 95,000 hectares to China and the committee demands to find it illegal. Ten deputies of parliament signed the appeal.
Beknazarov says President Askar Akayev signed the agreement in 1999 violating the constitution because did nit consult with the parliament and, according to the constitution, only the parliament has the right to change the state borders. Beknazarov also says the Legislative Assembly (lower chamber) of parliament violated the 59(1) and 65(6) articles of the constitution, the article 12 of the law on international agreements and the article 43 of the assembly regulations ratifying the agreement on 10 May.
